Pesticide Regulation in India

Legal Framework

Pesticides in India are primarily regulated under the Insecticides Act, 1968 and the Insecticides Rules, 1971.

The framework regulates:

  • import;
  • manufacture;
  • sale;
  • transport;
  • distribution;
  • use of insecticides and pesticides.

Its main objective is to prevent risk to human beings, animals and the environment from unsafe pesticide products.

The Central Insecticides Board and Registration Committee plays a central role in evaluating and registering pesticide products.

Registration and Approval

A pesticide cannot ordinarily be commercially manufactured, imported or sold in India without registration.

The registration process evaluates factors such as:

  • chemical composition;
  • toxicity;
  • efficacy against target pests;
  • residue behaviour;
  • environmental impact;
  • proposed dosage and method of use;
  • packaging and labelling.

Different formulations of the same active ingredient may require separate approval because concentration and mode of application can affect safety and effectiveness.

Registration may be granted provisionally or regularly depending on the available data and applicable legal provisions.

Central and State Authorities

The Central Insecticides Board advises the Union and state governments on technical matters relating to pesticide safety and use.

The Registration Committee examines applications and decides whether a pesticide should be registered.

State governments are responsible for several enforcement functions, including:

  • licensing of manufacturers and dealers;
  • inspection of premises;
  • collection of samples;
  • action against misbranded or unsafe pesticides;
  • prosecution of violations.

Insecticide Inspectors and Analysts play an important role in monitoring quality and legal compliance.

Banned and Restricted Pesticides

The government may prohibit or restrict pesticides when scientific evidence indicates unacceptable risks.

Regulatory action may include:

  • complete prohibition;
  • restriction to specific crops;
  • limitation of dosage or application method;
  • prohibition of certain formulations;
  • withdrawal of registration;
  • restrictions on manufacture or import.

Pesticides may be reviewed because of:

  • acute poisoning;
  • carcinogenicity;
  • environmental persistence;
  • harm to pollinators;
  • groundwater contamination;
  • excessive residues in food;
  • international regulatory developments.

Major Challenges

India faces several problems in pesticide regulation:

  • sale of spurious or substandard pesticides;
  • excessive and indiscriminate application;
  • poor farmer awareness;
  • pesticide residues in food;
  • occupational exposure of farm workers;
  • weak protective-equipment use;
  • illegal sale of banned products;
  • inadequate monitoring of environmental effects;
  • pesticide resistance among pests.

Small farmers may also rely heavily on dealer advice rather than independent agricultural extension services.

This can encourage unnecessary or inappropriate pesticide use.

Way Forward

A stronger regulatory system requires:

  • updated pesticide legislation;
  • transparent scientific review of active ingredients;
  • periodic re-evaluation of older pesticides;
  • stronger residue monitoring;
  • better enforcement against counterfeit products;
  • farmer training in safe application;
  • promotion of Integrated Pest Management;
  • wider use of biopesticides and biological control;
  • improved protective equipment;
  • digital tracking of licensed pesticide sales.

Regulation should also better integrate agriculture, public health, environmental protection and food-safety concerns.
