PM CARES Fund

Background and Objectives

The Prime Minister’s Citizen Assistance and Relief in Emergency Situations Fund, known as the PM CARES Fund, was established on 27 March 2020 during the COVID-19 pandemic.

It is registered as a public charitable trust and was created to provide assistance during emergencies, calamities and situations of distress, whether natural or human-made.

Its objectives include:

  • providing relief to affected populations;
  • supporting public-health emergencies;
  • creating or upgrading healthcare and pharmaceutical facilities;
  • financing emergency-related research;
  • supporting infrastructure required during disasters;
  • undertaking other activities consistent with emergency relief.

Its scope is broader than COVID-19 and extends to future emergencies and disasters.

Governance Structure

The Prime Minister of India serves as the ex-officio Chairperson of the Fund.

Its ex-officio trustees include the:

  • Minister of Defence;
  • Minister of Home Affairs;
  • Minister of Finance.

The Chairperson may nominate up to three additional trustees from fields such as research, health, science, social work, law, public administration and philanthropy.

Trustees serve in a pro bono capacity, meaning they do not receive remuneration for their role.

The Fund is administered with secretarial and administrative assistance from designated officials of the Prime Minister’s Office.

Funding and Financial Provisions

The Fund consists of voluntary contributions from:

  • individuals;
  • private organisations;
  • companies;
  • public-sector enterprises;
  • foreign individuals and organisations.

It does not receive direct budgetary support from the Union Government.

Donations to the Fund:

  • qualify for income-tax deduction under Section 80G;
  • may be counted as Corporate Social Responsibility expenditure by companies;
  • may be received from foreign sources due to exemption from the Foreign Contribution Regulation Act.

Budgetary resources of public-sector enterprises cannot be directly contributed, although voluntary and CSR contributions are permitted.

The Fund’s trustees determine the criteria for sanctioning and distributing financial assistance.

Utilisation and Accountability

The Fund has supported measures such as:

  • procurement of medical equipment;
  • establishment of oxygen-generation facilities;
  • development of healthcare infrastructure;
  • assistance for vaccine-related activities;
  • support for children who lost parents or guardians during the COVID-19 pandemic;
  • relief during emergencies and disasters.

Its accounts are audited by an independent chartered accountant appointed by the trustees. Audited receipts-and-payments statements are published on its official portal.

A major public debate concerns the extent of transparency and institutional accountability applicable to the Fund.

Important concerns include:

  • whether it should be treated as a public authority under the Right to Information framework;
  • whether its accounts should be audited by the Comptroller and Auditor General;
  • adequacy of information regarding donors and beneficiary selection;
  • concentration of administrative control among public office-holders.

Supporters argue that its flexible trust structure allows rapid mobilisation and deployment of resources during emergencies. Critics seek stronger statutory disclosure, independent oversight and clearer information regarding project-level expenditure.

PM CARES and Other Relief Funds

PM CARES is distinct from the Prime Minister’s National Relief Fund, which was established in 1948.

The National Disaster Response Fund is a statutory fund under the Disaster Management Act, 2005 and receives public budgetary resources. PM CARES is based on voluntary contributions and operates through a charitable trust structure.

In 2020, the Supreme Court held that contributions to PM CARES need not be transferred to the National Disaster Response Fund and that the two can operate independently.

Conclusion

PM CARES was established as a flexible emergency-relief mechanism capable of mobilising voluntary domestic and foreign contributions. Its institutional value lies in rapid resource mobilisation, but its long-term credibility depends on transparent disclosure, independent scrutiny and clear demonstration of how collected funds produce public benefit.
