Meaning and Scope

The Jammu and Kashmir Public Safety Act, 1978, commonly known as the PSA, is a preventive detention law applicable in the Union Territory of Jammu and Kashmir.

It allows the government to detain a person without ordinary criminal trial for preventive purposes when authorities believe that the person’s activities may threaten:

  • security of the state;
  • maintenance of public order.

The law is preventive rather than punitive. Its purpose is to stop anticipated harmful activity rather than punish a person for an offence already proved in court.

Grounds and Period of Detention

The Act broadly provides for detention on two major grounds:

Security of the State

A person may be detained if the government believes their activities are prejudicial to the security of the state.

Maintenance of Public Order

Detention may also be ordered where activities are considered harmful to public order.

The maximum period of detention differs according to the ground involved.

Generally:

  • detention for activities prejudicial to public order may extend up to 12 months;
  • detention for activities prejudicial to state security may extend up to 2 years.

The detention order may be issued by the government or by authorised senior administrative officers such as the Divisional Commissioner or District Magistrate.

Procedural Safeguards

A detainee must ordinarily be informed of the grounds of detention so that a representation can be made against the order.

However, authorities may withhold certain information when disclosure is considered contrary to public interest.

The detention order is reviewed through an Advisory Board, which examines whether sufficient cause exists for continued detention.

The government may confirm, modify or revoke the detention after considering the Board’s opinion.

Since preventive detention operates without a conventional criminal trial, procedural compliance is especially important.

Judicial Review and Criticism

Courts can review detention orders and may quash them where:

  • grounds are vague;
  • relevant material was not supplied to the detainee;
  • procedural requirements were violated;
  • representation was not considered properly;
  • detention was based on irrelevant material;
  • the order was passed mechanically or mala fide.

The Act has faced criticism because of concerns relating to:

  • detention without regular trial;
  • broad executive discretion;
  • repeated detention orders;
  • limited access to evidence;
  • possible use against political dissent;
  • tension with personal liberty under Article 21.

Supporters argue that the law provides a preventive mechanism in situations involving serious threats to security and public order.

Preventive detention should not be used merely because ordinary criminal prosecution is inconvenient or because evidence is insufficient for conviction.

Conclusion

The Jammu and Kashmir Public Safety Act, 1978 is a stringent preventive detention law intended to protect public order and state security. Because it permits detention without an ordinary criminal trial, its lawful use depends on narrow application, strict procedural safeguards and effective judicial review.
