Ad Hoc Parliamentary Committees

Meaning

Ad hoc Parliamentary Committees are temporary committees constituted by Parliament for a specific purpose or assignment.

They cease to exist once they:

  • complete the assigned task;
  • submit their report; or
  • are otherwise dissolved.

They differ from Standing Committees, which are permanent or periodically reconstituted bodies with continuing functions.

Major Types

Ad hoc committees broadly include:

  • Select Committees of one House;
  • Joint Committees of both Houses;
  • Joint Parliamentary Committees constituted for a specific inquiry;
  • other temporary committees created for a defined parliamentary purpose.

The exact composition, powers and tenure depend on the motion or parliamentary decision establishing the committee.

Select Committee

A Select Committee consists only of members of the House in which a Bill is pending.

It may examine a Bill:

  • clause by clause;
  • consult experts and stakeholders;
  • consider amendments;
  • submit recommendations to the House.

Its report is advisory. The House may accept, modify or reject its recommendations.

Joint Committee

A Joint Committee consists of members from both Lok Sabha and Rajya Sabha.

A Bill may be referred to such a committee when both Houses agree to detailed joint scrutiny.

Its functions may include:

  • examination of legislative provisions;
  • evidence from ministries and experts;
  • stakeholder consultation;
  • recommendations for amendment.

Joint Parliamentary Committee

A Joint Parliamentary Committee (JPC) is also an ad hoc committee of both Houses, usually constituted to examine a specific issue of major public importance or controversy.

A JPC may investigate matters such as:

  • financial irregularities;
  • policy failures;
  • major administrative controversies;
  • complex legislation.

Its mandate is defined by its terms of reference.

Powers

Depending on parliamentary rules and its mandate, an ad hoc committee may:

  • summon witnesses;
  • call for documents and records;
  • examine government officials;
  • receive expert evidence;
  • undertake detailed scrutiny;
  • submit findings and recommendations.

However, such committees are not courts and cannot ordinarily impose criminal penalties or directly enforce their recommendations.

Significance

Ad hoc committees are important because they allow Parliament to:

  • examine complex matters in greater detail than floor debate permits;
  • draw on specialised evidence;
  • conduct cross-party scrutiny;
  • investigate specific controversies;
  • improve legislative quality;
  • strengthen executive accountability.

They are especially useful when an issue does not fall neatly within the continuing jurisdiction of an existing Standing Committee.

Therefore, the quality of scrutiny depends on committee composition, mandate, access to evidence and seriousness of deliberation.
