Effective Majority

Meaning

  • Effective majority means a majority of the effective strength of the House.
  • The effective strength of a House is the total membership minus vacant seats. Members who are absent are still counted in the effective strength; only vacancies are excluded. This is the standard parliamentary meaning used in constitutional practice.

Basic formula

  • Effective majority = more than 50% of the effective strength of the House.
  • Effective strength = total membership – vacancies.
  • So it is different from simple majority because it is not based only on members present and voting. It is based on the working strength of the whole House after excluding vacancies.

Example

  • Suppose the total strength of a House is 245.
  • Suppose 5 seats are vacant.
  • Then the effective strength becomes 240.
  • Effective majority means more than half of 240, so at least 121 votes are needed.

Where it is usually relevant

  • Effective majority is generally associated with motions for removal from certain constitutional offices by the House itself, where the Constitution requires a majority of all the then members of the House.
  • In standard polity teaching, this is explained using examples like removal of the Deputy Chairman of Rajya Sabha or Deputy Speaker of Lok Sabha, where “all the then members” means the current effective strength of the House. This is the accepted constitutional understanding of effective majority.
