Introduction
- Article 334A is a new constitutional provision inserted by the Constitution (One Hundred and Sixth Amendment) Act, 2023. It deals with when and how reservation of seats for women will take effect in:
- the Lok Sabha
- State Legislative Assemblies
- the Legislative Assembly of the National Capital Territory of Delhi.
Why it was inserted
- Article 334A was inserted as part of the constitutional framework for women’s reservation in legislatures. The same amendment inserted:
- Article 330A for reservation in the House of the People
- Article 332A for reservation in State Legislative Assemblies
- related provisions in Article 239AA for Delhi.
Main purpose
- The main purpose of Article 334A is to specify:
- the commencement of women’s reservation
- its duration
- rotation of reserved seats
- and protection of the existing House/Assembly until dissolution.
Article 334A(1)
- Article 334A(1) says that the constitutional provisions relating to reservation of seats for women in the Lok Sabha, State Assemblies, and Delhi Assembly will come into effect only after a delimitation exercise is undertaken for this purpose after the relevant figures of the first census taken after the commencement of the 106th Amendment Act, 2023 have been published.
- It also says that these provisions shall cease to have effect on the expiration of 15 years from such commencement.
Practical meaning of clause (1)
- This means women’s reservation does not start immediately merely because the 106th Amendment was enacted. It starts only after:
- a future census after commencement of the Act
- publication of its relevant figures
- and a delimitation exercise based on that.
Article 334A(2)
- Article 334A(2) says that, subject to Articles 239AA, 330A and 332A, the seats reserved for women in the Lok Sabha, State Assemblies, and Delhi Assembly shall continue till such date as Parliament may by law determine.
Article 334A(3)
- Article 334A(3) provides that rotation of seats reserved for women in the Lok Sabha, State Assemblies, and Delhi Assembly shall take effect after each subsequent delimitation exercise, as Parliament may by law determine.
Article 334A(4)
- Article 334A(4) says that nothing in this article shall affect any representation in the:
- House of the People
- Legislative Assembly of a State
- Legislative Assembly of the NCT of Delhi
until the dissolution of the then existing House/Assembly.
Why Article 334A is important
- Article 334A is important because it is the constitutional provision that controls the actual operational timeline of women’s reservation. Without it, Articles 330A and 332A would not have a clear commencement framework.
- The most important exam point is that women’s reservation is constitutionally provided, but its implementation is postponed until post-census delimitation.
