Background

The Narmada Water Disputes Tribunal Award, 1979 was one of the most important inter-state river water dispute decisions in India. It dealt with the sharing of the waters of the Narmada River among the basin states.

The Narmada is one of the major west-flowing rivers of India. It originates from Amarkantak in Madhya Pradesh, flows through Madhya Pradesh, Maharashtra and Gujarat, and drains into the Arabian Sea through the Gulf of Khambhat.

The dispute arose mainly because Madhya Pradesh, Gujarat, Maharashtra and Rajasthan had competing claims over the use of Narmada waters for irrigation, drinking water, hydropower and regional development.

To resolve the dispute, the Government of India constituted the Narmada Water Disputes Tribunal under the Inter-State River Water Disputes Act, 1956. The Tribunal gave its final award in 1979.

Key Features of the Award

The Tribunal Award decided the allocation of Narmada waters among the concerned states and laid down the framework for major projects on the river, especially the Sardar Sarovar Project.

The Award fixed the utilisable flow of the Narmada River at 28 million acre-feet (MAF) at 75% dependability.

The water allocation was broadly as follows:

  • Madhya Pradesh: 18.25 MAF
  • Gujarat: 9.00 MAF
  • Rajasthan: 0.50 MAF
  • Maharashtra: 0.25 MAF

Madhya Pradesh received the largest share because most of the Narmada basin lies within the state. Gujarat received a major share because the Sardar Sarovar Project was expected to provide irrigation and drinking water benefits to drought-prone regions of Gujarat.

The Award also allowed Rajasthan to receive a smaller share even though it is not a riparian state of the Narmada. This was done mainly to support water-scarce areas of Rajasthan through canal-based supply.

Sardar Sarovar Project

The Narmada Tribunal Award is closely linked with the Sardar Sarovar Project. The project was planned as a large multipurpose river valley project on the Narmada River in Gujarat.

Its objectives included:

  • Irrigation development.
  • Drinking water supply.
  • Hydropower generation.
  • Drought-proofing of water-scarce regions.
  • Regional development in Gujarat, Rajasthan, Madhya Pradesh and Maharashtra.

The Tribunal Award fixed important project-related issues such as dam height, water sharing, power sharing and rehabilitation responsibilities.

The Sardar Sarovar Project later became one of the most debated development projects in India due to issues of displacement, rehabilitation, environmental impact and tribal rights.

Institutional Mechanism

The Award also provided for institutional mechanisms to implement and monitor its decisions.

Important institutions include:

  • Narmada Control Authority: It was created to implement the decisions of the Tribunal and coordinate between the states.
  • Review Committee: It was meant to review decisions and resolve implementation-related issues.
  • State-level agencies: These were responsible for project construction, canal development, rehabilitation and local implementation.

The Narmada Control Authority became important because large inter-state river projects require continuous coordination between states on water release, dam operations, rehabilitation and environmental safeguards.

The Narmada Bachao Andolan became a major people’s movement against the social and environmental costs of large dam projects on the Narmada River.

The movement raised issues related to:

  • Inadequate rehabilitation.
  • Loss of forests and livelihoods.
  • Environmental clearance concerns.
  • Need for people-centric development planning.
