Context: Model Code of Conduct
PM’s April 18 broadcast on Doordarshan, AIR, Sansad TV during elections has raised concerns of use of state-funded media under Model Code of Conduct (MCC).
Model Code of Conduct (MCC)
- Issued by Election Commission of India
- Non-statutory, applicable during elections
- Key rule: No use of official machinery/public resources (including public broadcasters)
→ Allegation: Broadcast on DD, AIR, Sansad TV = misuse of public resources → MCC violation
If MCC violated
- EC actions: warning, censure, advisory, temporary campaign ban (no direct legal penalty)
If RPA Violation is Proven — Legal Consequence
- Section 123(7), RPA 1951 → use of government machinery/officials = corrupt practice
→ If established:
- Election declared void
- Disqualification up to 6 years
